Abstract [It]: Il contributo esamina il caso Scalabrini nel quale la Corte costituzionale sudafricana ha avuto modo di chiarire, ancor più dettagliamente rispetto al passato, l’importanza e la portata del principio di non-refoulement; un’importanza tale da indurre i giudici di Johannesburg a dichiare incostituzionali alcune parti del Refugee Act (RA) del 1998, attraverso una retrospective declaration of invalidity in grado di salvaguardare i diritti dei richiedenti asilo sin dall’approvazione di quei due commi del RA che nel 2020 avevano introdotto le c.d. «abandonment provisions».
Title: The rights of asylum seekers in South Africa: further developments in recent case law
Abstract [En]: The paper examines the Scalabrini case, in which the South African Constitutional Court had the opportunity to clarify, in an even more detailed way than before, the importance and scope of the principle of non-refoulement. This principle was deemed so important by the Johannesburg judges that the Court declared parts of the 1998 Refugee Act (RA) unconstitutional, through a retrospective declaration of invalidity capable of safeguarding the rights of asylum seekers since the approval of those two paragraphs of the RA that had introduced the so-called "abandonment provisions" in 2020.
