 I 'beni culturali' dell’ambiente sociale

Abstract [It]: I beni culturali ambientali sono stati all’ordine del giorno della dottrina giuridica molti decenni orsono la quale ha proceduto da due differenti prospettive entrambe però unite dal maturato intento di suggerire una disciplina specifica di delineazione categoriale. Tuttavia la felice intuizione è rimasta sul piano dogmatico nei confini della problematica proprietaria, vale a dire del dominium –proprietario delle cose da includere in detta categoria. Il presente lavoro invece riportandosi al valore costituzionale dell’ambiente sociale, quasi negletto in dottrina, percorre l’itinerario differente che conduce all’epicentro ricostruttivo della categoria al di fuori della tradizionale generale tematica della proprietà   configurandola come beni (e/o interessi) della collettività e/o società e che la p.A. è tenuta soltanto ad amministrarla a favore di questa.

 

Abstract [En]: Many years ago, cultural and environmental heritage has been an issue on the agenda of legal scholars. They progressed from two perspectives sharing the acquired goal to suggest the specific regulation outlining the category. However, in terms of legal dogmatics the lucky guess remained within the boundaries of the ownership issue, which means within the dominium issue, the ownership of goods to be included in this category. Instead, this paper follows an alternative route, referring to the constitutional value of the social environment, almost unheeded by legal scholars. This alternative route leads to the epicentre of the meaning of the category: outside the traditional topic of the ownership, this path configures this category as assets (and/or interests) of the community and/or the civil-society, in favour of which Public Administration is required exclusively to manage these assets.
