Abstract [En]: Signed at the end of 2020 and defining a new framework for post-Brexit relations, the EU-UK Trade and Cooperation Agreement contains – in its provisions on level playing field in trade – an unusual reference to the European Social Charter. This article investigates the meaning and legal value of that reference, arguing that both parties to the agreement seem to consider it not just as a declaration of good intentions, but as a binding obligation, and that a first consequence of this reference was the UK denunciation of article 18.2 ESC, in July 2021.

Abstract [It]: Firmato a fine 2020 e fondamenta per un nuovo quadro di relazioni post-Brexit, l’Accordo sugli scambi e la cooperazione tra l’UE e il Regno Unito contiene – nelle sue disposizioni sulla parità di condizioni nel commercio – un insolito riferimento alla Carta Sociale Europea. L’articolo si interroga sul significato e sul valore giuridico di questo riferimento, argomentando che entrambe le parti dell’accordo sembrano considerarlo non come una semplice dichiarazione di buone intenzioni, ma come un’obbligazione vincolante, e che una prima conseguenza di questo riferimento può identificarsi nella denuncia da parte del Regno Unito dell’articolo 18.2 CSE, nel luglio del 2021.
