 La figura del Mediatore europeo tra diritto interno e diritto comparato

Abstract [It]: Il presente saggio affronta il tema, tra diritto interno ed esperienze comparate, del ruolo del Mediatore europeo, figura indipendente deputata a tutelare i cittadini da casi di cattiva amministrazione nell'operato delle istituzioni dell'Unione europea. Vengono analizzate, tra civil law e common law, le sue origini storiche, il dibattito circa la sua adozione, le basi giuridiche che ne definiscono compiti e poteri, ed il relativo perimetro di intervento.

Attraverso una misurazione dei dati ricavabili dalle Relazioni annuali, il saggio tenta di valutare l'efficacia del Mediatore, tanto interna quanto transnazionale, nel promuovere una migliore amministrazione pubblica e nel rafforzare la fiducia dei cittadini nelle istituzioni europee.

 

Title: The European Ombudsman: Between National and Comparative Law

Abstract [En]: The present essay examines the role, between national law and comparative experiences, of the European Ombudsman, an independent figure tasked with protecting citizens from cases of maladministration in the activities of the European Union institutions. The essay analyzes, from a civil law and common law perspective, its historical origins, the debate surrounding its adoption, the legal bases that define its tasks and powers, and the relative scope of its intervention. Through a measurement of the data collected from the Annual Reports, the essay attempts to assess the effectiveness of the Ombudsman, both domestically and transnationally, in promoting better public administration and strengthening citizens' trust in European institutions.
