luce della sentenza n. 192 del 2024. Sebbene i testi individuino specifiche funzioni e introducano maggiori garanzie finanziarie e organizzative, essi risultano sostanzialmente uniformi per tutte le Regioni.

Manca una motivazione concreta e individualizzata che colleghi le attribuzioni richieste alle peculiarità territoriali e dimostri la maggiore adeguatezza del livello regionale. Permangono inoltre dubbi sull’attualità dell’iniziativa, sul coinvolgimento degli enti locali e sull’effettività dell’intervento parlamentare. Il rischio è che l’autonomia differenziata si trasformi in un modello seriale, formalmente differenziato ma sostanzialmente uniforme.

 

Title: Back to square one. The new preliminary agreements on differentiated autonomy: balancing regional specificities and uniformity in negotiations

Abstract [En]: This paper analyses the 2025 preliminary agreements and the 2026 draft schemes on differentiated autonomy in the light of Judgment No. 192 of 2024. Although the texts identify specific functions and introduce greater financial and organisational safeguards, they are essentially uniform across all regions. There is a lack of concrete and individualised justification linking the requested powers to specific territorial characteristics and demonstrating that the regional level is more appropriate. Furthermore, doubts remain regarding the timeliness of the initiative, the involvement of local authorities and the effectiveness of parliamentary action. The risk is that differentiated autonomy will become a standardised model, formally differentiated but essentially uniform.
