La solidarietà verso le generazioni future a fondamento della giustizia climatica. Note a partire dal Fondo Loss and Damage istituito dalla recente Cop 27

Abstract [It]: La recente adozione in sede di Cop 27 del Fondo Loss and Damage costituisce un indubbio passo in avanti verso la realizzazione della giustizia climatica, che trova nella solidarietà il suo valore fondativo. Il Fondo, però, risarcisce solo gli Stati “materialmente vulnerabili” agli effetti negativi del cambiamento climatico e non fornisce titolo per il risarcimento delle persone. In questo contributo, si ambisce, quindi, sottolineare le ragioni dell’inderogabilità di una solidarietà, intergenerazionale, che si rivolga non soltanto agli Stati, ma anche agli individui, presenti e futuri.

Title: Solidarity towards future generations as the foundation of climate justice. Notes starting from the Loss and Damage Fund established by the recent Cop 27.

Abstract [En]: The recent adoption in COP 27 of the Loss and Damage Fund constitutes an undoubted step forward towards the realization of climate justice, which finds its founding value in solidarity. However, the Fund only compensates states that are “materially vulnerable” to the negative effects of climate change and does not provide entitlement to compensate individuals. In this contribution, therefore, the aim is to underline the reasons for the imperative nature of an intergenerational solidarity that is addressed not only to states, but also to individuals, present and future.
