 The implementation of the EU’s Green Deal as a ‘trump card’ for the State legislator towards regional regulatory autonomy?

Abstract [En]: The essay examines the impact of the EU’s Energy Transition on the autonomy of Italian Regions with regard to the installation and expansion of plants powered by renewable energy sources, also in light of the most recent developments in the regulatory and jurisprudential framework. In the end, it outlines also some measures that, from a de iure condendo perspective, could promote a greater sharing of strategic energy policy decisions between the national legislator and local communities.

 

Titolo: L'attuazione del Green Deal dell'UE come “carta vincente” per il legislatore statale verso l'autonomia normativa regionale?

Abstract [It]: Il contributo prende in esame l’impatto della cd. Transizione energetica europea sull’autonomia delle Regioni italiane, con specifico riferimento all’installazione e all’ampliamento degli impianti alimentati da fonti rinnovabili, anche alla luce delle più recenti evoluzioni del quadro normativo e giurisprudenziale. Nella parte conclusiva, esso prospetta alcune misure che, in prospettiva de iure condendo, potrebbero favorire una maggiore condivisione delle scelte strategiche in materia energetica tra legislatore nazionale e comunità locali.
