Abstract [It]: Con la sentenza “Minister of Safety and Security and others v. Kennedy and another” la Supreme Court della Namibia affronta alcune rilevanti questioni in merito ai diritti costituzionali dei detenuti, in particolare il principio di presunzione di innocenza, il diritto a ricevere visite e l’utilizzo delle misure di isolamento. La sentenza viene affrontata nel contesto della tradizione giuridica namibiana, che influenza tanto l’esito della decisione, tanto lo “stile” della sentenza stessa.

Title: The constitutional protection of prisoners' rights in Namibia. The case "Minister of Safety and Security and others v. Kennedy and another" between history and legal tradition

Abstract [En]: With the judgment 'Minister of Safety and Security and others v. Kennedy and another', the Supreme Court of Namibia addresses some relevant issues concerning the constitutional rights of detainees, in particular the principle of presumption of innocence, the right to visitation and the use of solitary confinement. The ruling is approached in the context of the Namibian legal tradition, which influences both the outcome of the decision and the 'style' of the ruling itself.
