 Finalità e impianto della nuova legge sulla montagna: il nodo delle nozioni di comune montano

Abstract [It]: Il contributo prende in esame la recente legge 12 settembre 2025, n. 131, inquadrandola nel diritto dell’Unione europea e dei principi della Costituzione italiana; si sofferma su finalità e impianto della legge, con riferimento anche agli atti normativi conseguenti. In particolare, ci si sofferma sulle norme della legge che delineano, in attesa dei decreti del Presidente del Consiglio dei Ministri, le nozioni di Comune montano.

 

Title: Purposes and structure of the new mountain law: the issue of the definitions of a mountain municipality

Abstract [En]: The paper examines the recent Law of 12 September 2025, no. 131, placing it within the framework of European Union law and the principles of the Italian Constitution. It focuses on the purposes and structure of the law, also with reference to the subsequent implementing measures. In particular, it analyzes the provisions of the law that, pending the decrees of the President of the Council of Ministers, define the notions of a mountain municipality.
