 La relazione tra sfruttamento e (in)sicurezza sul lavoro

Abstract [It]: Il saggio riflette sul rapporto tra sfruttamento lavorativo e insicurezza, nella loro intersezione fenomenologica e regolativa. Alla luce del fatto che il lavoro sfruttato – disciplinato in larga misura dal diritto penale – risulta ancora privo di una chiara ed espressa definizione giuslavoristica, l’Autrice indaga sui possibili e rinnovati percorsi interpretativi che accomunano la tutela dei beni giuridici della dignità, della salute e della sicurezza del lavoro, nell’auspicio di una risposta ordinamentale di migliore tutela. Sul piano specifico, la disciplina della Due Diligence è individuata come possibile soluzione, benché ancora in progress.

 

Title: The relationship between exploitation and (in)security at work: a constitutionally oriented perspective

Abstract [En]: This essay examines the relationship between labour exploitation and insecurity, focusing on their phenomenological and regulatory intersections. Given that exploited labour – largely governed by criminal law – still lacks a clear and explicit definition under labour law, the Author explores possible and renewed interpretative approaches that bring together the protection of the legal rights to dignity, health and safety at work, in the hope of a legal framework for a better protection. Specifically, the regulation of Due Diligence is identified as a possible solution, although still a work in progress.
