Abstract [It]: Il contributo ricostruisce la disciplina della progressione di “carriera” in magistratura per il conferimento delle funzioni di legittimità. Si esamina il rilievo attribuito alle pubblicazioni scientifiche e al giudizio delle commissioni tecniche. Si mostra come tali parametri rischino di alimentare nuove forme di “carrierismo” e di sganciare la progressione dall’esercizio della funzione giurisdizionale, evidenziando le tensioni tra indipendenza, responsabilità e valutazioni professionali.

 

Title: Technical commissions and scholarly publications in appointments to the Court of Cassation. Constitutional issues and critical remarks

Abstract [En]: The article reconstructs the regulatory framework governing “career” progression in the judiciary for access to the Court of Cassation. It examines the weight accorded to judges’ scholarly publications and to the opinions of technical commissions. It argues that these parameters risk fuelling new forms of judicial “careerism” and disconnecting progression from the actual exercise of adjudication, thereby highlighting tensions between independence, accountability and professional evaluation.
