Chi inquina paga? Luci e ombre sull’effettività delle tutele nel sistema africano per violazioni derivanti da attività d’impresa (caso Trafigura)

Abstract [It]: Con la sentenza LIDHO e altri c. Costa d’Avorio, la Corte africana ha accertato diverse violazioni della Carta africana in un caso di traffico e sversamento illecito di rifiuti provenienti da una multinazionale estera. Questa rilevante pronuncia affronta il delicato tema dei rapporti tra attività di impresa e violazioni dei diritti umani, con tutta una serie di soluzioni, spesso innovative, proprie del sistema africano di tutela dei diritti umani sia dal punto di vista procedurale che sostanziale, disvelando al tempo stesso le sue attuali difficoltà in punto di effettività delle tutele.

Title: Polluter pays? Lights and shadows on the effectiveness of protections in the African system for violations arising from business activities (the Trafigura case)

Abstract [En]: In its judgment LIDHO and Others v. Republic of Côte d’Ivoire, the African Court found several violations of the African Charter in a case involving the illegal trafficking and dumping of waste by a foreign multinational company. This important ruling addresses the complex issue of the relationship between business activities and human rights violations, with a whole series of solutions, often innovative, specific to the African system of human rights protection from both a procedural and substantive point of view, while at the same time it bears witness to the current difficulties in terms of the effectiveness of protections.
