La leale collaborazione nell’emergenza sanitaria. Il ruolo del conflitto di attribuzione fra Stato e regioni

Abstract [It]: Lo studio si sofferma sul ruolo della Corte costituzionale nei rapporti fra Stato e regioni, con particolare riferimento al giudizio sui conflitti di attribuzione intersoggettivi, nel periodo dell’emergenza sanitaria. Partendo dall’unica questione promossa in tale sede nel corso dell’emergenza sanitaria, emerge la circostanza che, rispetto agli atti non legislativi, Stato e regioni in situazioni di contrasto hanno preferito fare ricorso al giudice amministrativo. Tale circostanza induce ad una riflessione sull’attualità del giudizio costituzionale sui conflitti intersoggettivi rispetto a quelle situazioni di contrasto che possono sorgere fra Stato e regioni in una situazione di emergenza; la scelta di ricorrere al giudice amministrativo richiede una ponderazione dei diversi fattori che possono aver inciso nelle valutazioni dei ricorrenti e che inducono ad una lettura coordinata dei diversi giudizi, nella consapevolezza del ruolo della Corte all’interno dell’ordinamento giuridico.

Title: Loyal cooperation in health emergencies. The role of the conflict of attribution between State and regions

Abstract [En]: The study focuses on the role of the Constitutional Court in the relations between State and regions, with reference to the judgment on attribution conflicts, in the period of health emergency. Because of the only question raised there during the health emergency, the fact emerges that, compared to non-legislative acts, the State and regions in conflict situations preferred to have recourse to the administrative court. This circumstance leads to a reflection on the topicality of the constitutional judgment on conflicts with respect to those situations of conflict that may arise between the State and regions in an emergency situation; the choice of recourse to the administrative court requires a weighting of the various factors which may have had an impact on the applicants' assessments and which lead to a coordinated reading of the different judgments, aware of the role of the Court within the legal order.
