 L’esercizio della funzione legislativa da parte del Parlamento britannico durante il processo della Brexit: alcune luci e molte ombre

Abstract [It]: Il contributo analizza come la funzione legislativa del Parlamento si è trasformata durante il processo della Brexit, evidenziando, da un lato, elementi di continuità e di discontinuità rispetto alle procedure in essere, con particolare riferimento al rapporto tra Parlamento e Governo, al successo dei private members bills e al ruolo della Camera dei Lord; dall’altro, l’esponenziale crescita di poteri normativi in capo all’Esecutivo per effetto dell’ampia delega ad esso conferita per la modifica e l’abrogazione della retained EU law. Infine, si esamina anche la controversa abrogazione del Fixed Term Parliaments Act 2011 quale caso di auto-limitazione di poteri da parte del Parlamento.

 

Title: The exercise of the legislative function by the Parliament during the Brexit process: Some lights and many shadows

Abstract [En]: The article analyses how the legislative function of Parliament has been transformed during the Brexit process, highlighting, on the one hand, elements of continuity and discontinuity compared to the pre-existing procedures, in particular with regard to the relationship between the Parliament and the Government, the success of private members bills and the role of the House of Lords; on the other, the staggering growth of the Executive’s rule-making powers as a consequence of the wide delegation conferred to modify and repeal retained EU law. Finally, it deals with the controversial repeal of the Fixed Term Parliaments Act 2011 as a case of Parliament’s self-disempowerment by law.
