England Unincorporated: Reflections on the Constitutional Way Ahead post Brexit?

Abstract [En]: This article addresses a series of constitutional issues related to the Brexit experience from an English perspective. The first section identifies a democratic deficit at the heart of the UK parliamentary system and it outlines the case for the introduction of a proportional element to the electoral system for the House of Commons and an elected Senate for the regions to replace the House of Lords. The second section provides a contextual discussion of the government initiative to create city regions as a method distributing power downwards to English regions and also addressing the asymmetry caused by devolution. The final section, which considers the Internal Markets Act and the Subsidy control bill, is specifically devoted to the fallout from Brexit. It argues that the attempt to create a uniform UK wide market also constitutes a re-assertion of sovereignty and sets up clashes with the competences of devolved government in Scotland, Wales and Northern Ireland. In turn, this provides impetus for the eventual break-up of the United Kingdom.

Abstract [It]: L’articolo affronta una serie di questioni di tono costituzionale collegate all’esperienza della Brexit dalla prospettiva dell’Inghilterra. Il primo paragrafo identifica un problema di deficit democratico nel cuore del sistema parlamentare britannico e delinea come soluzione quella dell’introduzione di elementi proprio di un regime proporzionale nel sistema di elezione della Camera dei Comuni accanto ad un Senato delle regioni che sostituisca la Camera dei Lord. Il secondo paragrafo cerca di contestualizzare la discussione sull’iniziativa governativa di istituire “regioni cittadine” (city regions) come strumento per conferire poteri alle regioni inglesi e per affrontare il nodo dell’asimmetria indotta dalla devolution. L’ultimo paragrafo, the analizza l’Internal Market Act e il Subsidy control bill, si concentra specificamente sulle ricadute della Brexit. Si sostiene che il tentativo di creare un mercato interno con regole uniformi in tutto il Regno Unito rappresenta una riaffermazione di sovranità dal centro e rischia di entrare in conflitto con le competenze dei governo devoluti in Scozia, Galles e Irlanda del Nord. A sua volta, ciò potrebbe condurre all’eventuale disintegrazione del Regno Unito.
