 The Prospects for Scottish Independence in the Aftermath of Brexit

Abstract [En]: In the Brexit referendum a majority of Scottish voters wished to remain in the European Union. The pursuit of Brexit with no concession to Scotland’s Remain vote has reignited the independence debate. The Scottish Government is seeking to hold a second independence referendum, presenting a constitutional case based on three claims. This article examines each element of the constitutional case presented by the Scottish Government, and considers how the present constitutional stalemate between the two governments might be overcome.

 

Titolo: Le prospettive per l’indipendenza scozzese dopo la Brexit

Abstract [It]: In occasione del referendum sulla Brexit la maggioranza degli elettori scozzesi sarebbe voluta rimanere nell’Unione europea. Il perseguimento della Brexit senza fare concessioni alla posizione scozzese sul “Remain” ha riacceso il dibattito sull'indipendenza. Il governo scozzese sta cercando di indire un secondo referendum sull'indipendenza, avanzando tre rivendicazioni. Questo articolo esamina ogni elemento del ricorso costituzionale presentato dal governo scozzese, e considera come l'attuale stallo costituzionale tra i due governi potrebbe essere superato.
