 Northern Ireland's Post-Brexit Constitution

Abstract [En]: The article briefly describes the nature of the Belfast Agreement, before turning to note the content and structure of the Ireland-Northern Ireland Protocol. It then considers the decision of the Court of Appeal in Allister and its findings in relation to the consent principle. The Court of Appeal essentially reasoned that the UK Parliament has given domestic legal effect to the Protocol in a manner that is intended to override Article 6 of the Act of Union. The article offers some comments about what this means for Northern Ireland’s constitution in its current state of development, as well as for patterns in judicial decision-making in the wider UK constitution. It concludes with some comments about constitutional futures on the island of Ireland

 

Titolo: La Costituzione dell’Irlanda del Nord post-Brexit

Abstract [It]: L’articolo descrive brevemente la natura del Belfast Agreement, prima di focalizzarsi sul contenuto e sulla struttura del Protocollo sull’Irlanda-Irlanda del Nord. Quindi, si considera la decisione della Corte di Appello nel caso Allister e le sue conclusioni in relazione al principio del consenso. In sostanza, per la Corte d’Appello, il Parlamento britannico ha dato seguito al Protocollo violando l’art. 6 dell’Act of Union. L’articolo riflette su ciò che questo implica per la Costituizione dell’Irlanda del Nord nel suo attuale stato di sviluppo così come per il trend circa il ruolo del giudiziario nell’ambito della Costituzione britannica in senso lato. Infine, le riflessioni conclusive sono dedicate al futuro costituzionale dell’isola d’Irlanda.
