 The effects of Brexit on the law of UK trade

Abstract [En]: The law governing how the UK trades with the rest of the world has changed a lot because of Brexit. This article seeks to familiarise the reader to the process of transformation of trade law, from the EU internal market to the new status quo of the Trade and Cooperation Agreement, not without explaining the effects that a “no deal” scenario would have entailed. Ultimately, this account should make clear that the current arrangements are better understood and assessed as a decent free trade agreement (better than trading on WTO terms), rather than an adjustment of the preferential relationship of the internal market.

 

Titolo: Gli effetti della Brexit sul diritto britannico degli scambi

Abstract [It]: Le norme che regolano gli scambi commerciali del Regno Unito col resto del mondo sono cambiate notevolmente a causa della Brexit. Questo articolo cerca di avvicinare il lettore a tale processo di trasformazione del diritto del commercio, dal mercato interno UE al nuovo status quo dell’accordo sugli scambi commerciali e la cooperazione, analizzando in ogni caso gli effetti che lo scenario del “no deal” avrebbe determinato. In sostanza, questa analisi mira a chiarire che lo scenario attuale è meglio inteso e giudicato come parte di un accordo di libero scambio piuttosto efficace (sempre meglio che se gli scambi fossero sorretti solo dalle regole dell’OMC), piuttosto che come un adeguamento al ribasso del rapporto preferenziale che caratterizza il mercato interno UE.
