 La disinformazione, i contenuti illegali e i limiti alla libertà di espressione online: un’inevitabile evaporazione delle garanzie costituzionali?

Abstract [It]: Il contributo analizza i limiti all’esercizio della libertà di espressione online. L’autore si concentra in primo luogo sulle esperienze tedesca e francese per verificare la compatibilità tra un controllo efficiente dell’espressione online e le tutele costituzionali previste per questa libertà. Le difficoltà che emergono a livello nazionale non vengono superate dal Digital Services Act, che crea le condizioni per reagire probabilmente meglio ai contenuti illegali, ma senza rispettare pienamente gli standards costituzionali.

 

Title: Disinformation, Illegal Contents and Limits on Freedom of Expression Online: An inevitable Evaporation of Constitutional Guarantees?

Abstract [En]: The paper analyzes the limits on freedom of expression when it is exercised online. The author focuses first on the German and the French experiences in order to check the compatibility between an efficient control of online expression and the constitutional protections provided for this freedom. The difficulties that emerge at the national level are not overcome by the EU Digital Services Act, that probably creates the conditions to better react against illegal content, but without fully complying with the constitutional standards.
