La tutela penale degli interessi finanziari dell’Unione Europea al crocevia tra mutuo riconoscimento ed integrazione

Abstract [It]: Il contributo analizza le garanzie costituzionali del sistema penale in relazione alla tutela degli interessi finanziari dell’Unione Europea. Dopo aver delineato il quadro normativo vigente, il saggio si sofferma criticamente sulle implicazioni della struttura predisposta dalla Direttiva (UE) 2017/1371 e dal Regolamento (UE) 2017/1939. Viene esaminato il ruolo della Procura Europea (EPPO) e le tensioni derivanti dal coordinamento tra ordinamenti nazionali e diritto dell’Unione. Infine, si riflette su possibili alternative al ricorso alla sanzione penale, tra le quali una possibile valorizzazione delle funzioni di controllo della Corte dei conti.

Title: Criminal Protection of the European Union’s Financial Interests: Between Mutual Recognition and Integration

Abstract [En]: The paper analyzes the constitutional guarantees of the criminal justice system in relation to the protection of the financial interests of the European Union. After outlining the current regulatory framework, the essay critically focuses on the implications of the structure established by Directive (EU) 2017/1371 and Regulation (EU) 2017/1939. The role of the European Public Prosecutor’s Office (EPPO) and the tensions arising from the coordination between national legal systems and Union law are examined. Finally, reflection is given to possible alternatives to the recourse to criminal sanctions, among which is the potential enhancement of the control functions of the Court of Auditors.
